The Chilean social outbreak that originated in October 2019 was a manifestation of the constituent power. The people, with a political sense, protested against the unworthy conditions through which life is currently structured in Chilean society. Fundamental rights seek to protect human dignity, a concept that is difficult to grasp. Dignity understood from formalism cannot explain why there are people without material conditions of existence. A material conception of dignity helps to better understand the meaning of the revolt. The current (...) constituent moment invites us to think about the convenience of applying a transformative constitutionalism, which broadens the concept of citizenship and advances in social rights. RESUMEN En este trabajo intento determinar, a partir de textos escogidos de todas las épocas de la producción teórica de Carl Schmitt, de qué manera este autor entiende la comprensión jurídica y de qué manera este modo de comprensión tiene alcances generales para la comprensión práctica. En la medida en que el derecho tematiza las condiciones y los polos de la comprensión, la posición del jurista se distancia tanto de la inclinación hacia el polo ideal, que Schmitt identifica con la (...) racionalidad tecnológica, cuanto de la inclinación hacia el polo real, que Schmitt liga a ciertas formas del romanticismo y el pensamiento teológico. RESUMO Neste artigo, tento determinar, a partir de textos selecionados de todos os períodos da produção teórica de Carl Schmitt, como esse autor entende a compreensão jurídica e como esse modo de compreensão tem alcance geral para a compreensão prática. Na medida em que o direito estuda as condições e os polos de compreensão, a posição do jurista distancia-se da inclinação para o polo ideal, que Schmitt identifica com a racionalidade tecnológica, bem como da inclinação para o polo real, que Schmitt conecta com certas formas de romantismo e pensamento teológico. The article approaches Salomon Maimon’s reinterpretation of the notions of the thing in itself and the given within the framework of criticism. For Maimon they do not refer to a transcendence that is directly unattainable by knowledge. In this attempt, he tries to explain the given on the basis of the action of constitutive understanding. With this, he triggers the passage from transcendental Kantian philosophy to the idealism of Fichte. Nonetheless, his position faces the subsequent problem of explaining how the (...) constitution of the given from understanding (infinite) can become compatible with the criticism it takes on. On affirming that an uncognoscible item is the basis of knowledge, namely, infinite understanding, he set aside the explanation of knowledge in terms of what is revealed in it and in doing so would be resorting to external uncognoscible conditions. De acordo com as interpretações mais conhecidas (por exemplo, Hofmann, Strauss, Löwith ou Kuhn), o pensamento jurídico e político de Carl Schmitt mantém distância de Aristóteles. Este artigo tem a intenção de mostrar que a concepção de direito de Schmitt, apesar de ser desenvolvida em um contexto diferente, contém semelhanças significativas com o entendimento de direito em Aristóteles. Para mostrar essa proximidade, considera-se especialmente a noção de totalidade presente no conceito aristotélico de polis, que implica que a unidade política é (...) o principal modo de se realizar o direito. According to mostly known interpretations (e.g.: Hofman, Strauss, Löwith or Kuhn), the legal and political thought of Carl Schmitt keeps distance from Aristotle's. This article intends to show that Schmitt's concept of law, despite developed in a different context, holds significant likelihood with Aristotle's comprehension of law. With the Purpose of building this proximity, the notion of entirety present in the Aristotelic concept of polis implies that political unit is the main way to accomplish law. (shrink)

En este artículo se analiza el comentario de Maimon al intento kantiano de vincular sensibilidad y entendimiento. En la Crítica de la razón pura, Kant distingue dos facultades de conocimiento, que deben ser unidas para que el conocimiento objetivo sea posible. Maimon cuestiona que la vinculación sea realizable. Luego de exponer el punto de partida kantiano, se analizan los argumentos maimonianos, planteando dificultades sistemáticas que afectarían al intento de vinculación kantiano.

El presente artículo indaga si ¿es el sujeto un ser autónomo en la deliberación política o sonlos pensamientos, las posturas y las formas de la organización política mediadas por las distintas herramientas comunicacionales a las que se ve expuesto quienes lo determinan? Así, analiza larelación que existe entre mass media y política, con la capacidad deliberativa del individuo altomar decisiones en el contexto político, a partir de Chomsky y Han. La metodología es cualitativa con diseño documental, el instrumento son fichas (...) bibliográficas aplicadas a fuentes primarias y secundarias. Se usan bases de datos con el algoritmo: “Neoliberalismo, psicopolítica, big data, medios de comunicación de masas y democracia”. Se analizan 13 libros y 20 artículos. Se identifican las nuevas formas y herramientas de organización política y la relación entre política y medios de comunicación. Se concluye que: 1) el neoliberalismo direcciona la idea de libre mercado hacia el individuo mismo, 2) es necesaria una ciudadanía crítica que tenga un rol más activo en lademocracia, 3) se identifica a la psicopolítica como una nueva forma de organización política, 4) lanueva herramienta de la política es el big data, 5) se evidencia que la relación entre política y massmedia está vinculada con los grupos de poder y 6) la emocionalización de la comunicación políticadisminuye la autonomía individual. Olympic combat sports are unconventional physical activity strategies to train middle-aged and older people with and without health problems. This systematic review aimed to assess the available body of published peer-reviewed articles related to the effects of Olympic combat sports interventions on health-related quality of life in adults aged 45 and older. The search was carried out in five generic databases until July 2021 and the protocol was registered in PROSPERO. The PRISMA guidelines were followed and the Downs and Black (...) checklist was used to assessed the methodological quality of the studies. After reviewing 1,151 records, only seven studies met the inclusion criteria, adding 212 participants with a mean age of 63.7 years. Six studies provided data to calculate the effect size in the Olympic combat sports groups. Three studies reported beneficial changes with a small ES for the total score of the health-related quality of life. Two studies reported a beneficial change with a small ES and strong ES for physical health. One study reported improvements with a small ES for emotional and functional well-being. In conclusion, interventions based on Olympic combat sports produce beneficial effects with a small and moderate ES on health-related quality of life in male and female aged 45 and older who are healthy participants, participants with Parkinson's disease, and participants with breast cancer.Systematic Review Registration:https://www.crd.york.ac.uk/prospero/, PROSPERO: CRD42021244161. Unfounded—conspiracy and health—beliefs about COVID-19 have accompanied the pandemic worldwide. Here, we examined cross-nationally the structure and correlates of these beliefs with an 8-item scale, using a multigroup confirmatory factor analysis. We obtained a two-factor model of unfounded (conspiracy and health) beliefs with good internal structure (average CFI = 0.98, RMSEA = 0.05, SRMR = 0.04), but a high correlation between the two factors (average latent factor correlation = 0.57). This model was replicable across 50 countries (total N = 13,579), (...) as evidenced by metric invariance between countries (CFI = 0.96, RMSEA = 0.06, SRMS = 0.07) as well as scalar invariance across genders (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03) and educational levels (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03). Also, lower levels of education, more fear of COVID-19, and more cynicism were weakly associated with stronger conspiracy and health beliefs. The study contributes to knowledge about the structure of unfounded beliefs, and reveals the potential relevance of affective (i.e., fear of COVID-19) and cognitive (i.e., cynicism) factors along with demographics, in endorsing such beliefs. In summary, we obtained cross-cultural evidence for the distinctiveness of unfounded conspiracy and health beliefs about COVID-19 in terms of their structure and correlates. (shrink)

In this note, the problem of tracking random references and rejecting random perturbations in a quadrotor, both generated by an auxiliary system named exosystem, is solved by extending the deterministic tracking problem to the area of stochastic processes. Besides, it is considered that only a part of the state vector of the quadrotor is available through measurements. As a consequence, the state vector of the plant must be estimated in order to close the control loop. On this basis, a controller (...) to track random references and to reject random perturbations is developed by combining a Kalman filter to estimate the references and perturbations of an exosystem and an observer to estimate the states of a quadrotor. Besides, to obtain a more practical controller, the analysis is carried out in discrete time. Numerical simulations are used in a quadrotor to confirm the validity and effectiveness of the proposed control. (shrink)

En este trabajo, revisamos la literatura clásica en modularidad cognitiva. Ofrecemos una descripción cognitiva neuronal de la modularidad, que incluye: patrones de disfunción específicos, la doble disociación, una actividad cerebral asociada, y un proceso de especialización funcional. Posteriormente, analizamos un módulo de cognición social, i.e., el módulo de detección de tramposos. Compilamos las objeciones clásicas a este módulo, y ofrecemos algunas nuevas, para posteriormente contrastarlas con las primeras. Nuestro frenesí de comunicación e información hace que las cosas des- aparezcan y devengan en no-cosas, también llamadas informaciones (Han, 2021: 10). El marco ontológico presente es resultado de un desplazamiento que va del ocaso de las cosas al consumo rápido y frenético de no-cosas. En este entorno intangible el ser humano ya no maneja ninguna cosa. Las no cosas son aquellas cosas puramente intangibles, que no pueden aprehenderse con las manos. Manuel Herrera Gómez es Profesor Titular de Sociología de la Universidad de Granada (1998). En las últimas décadas se ha desarrollado un (...) intenso debate que contrapone a los defensores de un modelo liberal de sociedad y a los que apuestan por un modelo comunitario. Bajo el manto liberal se engloban todas aquellas teorías políticas cuyo objetivo es buscar procedimientos, universalmente compartidos, de agregación de los intereses individuales. Por su parte, en el bando comunitarista, nos encontramos aquellos planteamientos -cuyo denominador común es una crítica a toda visión puramente procedimentalista de la filosofía pública-, que consideran que sólo se posee una comunidad política cuando se recurre a un patrimonio común de contenidos, valores y tradiciones, en el que todos los miembros de la comunidad se sienten radicados. En esta obra se presenta un análisis detallado de los protagonistas y de las etapas de este debate, proponiendo como conclusión un modelo de sociedad que pretende dar respuesta tanto a las instancias radicadas en el modelo procedimental como a las presentes en el modelo comunitario. The “boomerang thesis” enjoys widespread currency in contemporary scholarship: that the means and ends of colonial domination would “spin back” to the metropole is an idea with intuitive grip. This article extrapolates the depth of meaning this metaphor contains, as well as what it conceals. It first considers the “boomerang” as it appears in Aimé Césaire’s Discourse on Colonialism, a poetic work that captures the moral and experiential return-effects of imperial violence. Turning to Hannah Arendt’s The Origins of Totalitarianism—the only (...) articulation of the thesis that uses the word “boomerang”—the article disaggregates the teleological, ideological, and institutional elements that spun back from European colonies in the imperial era. Finally, it traces the development of the thesis in Michel Foucault’s “Society Must Be Defended,” where it is transformed into a more general explanatory mechanism. Each theorist indicates how distance operates to transform dubious, even hateful ideas into acceptable practices. (shrink)

Background:Decision-making and assessment in emergency situations are complex and result many times in ethical conflicts between different healthcare professionals.Aim:To analyse and describe situations that can generate ethical conflict among nurses working in emergency situations.Methods:Qualitative analysis. A total of 16 emergency nurses took part in interviews and a focus group.Ethical considerations:Organisational approval by the University Hospital, and informed consent and confidentiality were ensured before conducting the research.Result/conclusion:Two categories emerged: one in ‘ethical issues’ and one in ‘emotions and feelings in caring’. The (...) four ethical subcategories are presented: Autonomy, the first sub category: first, the nurse’s ability to practise care on an emergency ward and, second, to support the patient and/or relatives in terms of care and medical treatment. The conflicts arise when the nurse ends up in the middle between the patient and the physician responsible for the diagnosis and treatment from a nature scientific perspective. Reification of injured body: patient was often reified and fragmented, becoming just a leg or arm. Different factors contributed in this perspective. Pain: pain relief was often inadequate but more effectively treated in the emergency medical services than at the emergency department. The nurses highlighted the phenomenon of suffering because they felt that pain was only an object, forgetting the patients’ care need, like separating mind from body. Death: the nurses felt that the emergency services are only prepared to save lives and not to take care of the needs of patients with ‘end-of-life’ care. Another issue was the lack of ethical guidelines during a cardiac arrest. Resuscitation often continues without asking about the patient’s ‘previous wishes’ in terms of resuscitation or not. In these situations, the nurses describe an ethical conflict with the physician in performing their role as the patient’s advocate. The nurses express feelings of distress, suffering, anger and helplessness. (shrink)

The aim of this research is to develop and validate a measurement scale for consumer’s perceptions of corporate social responsibility using the three-dimensional social, environmental and economic conceptual approach as a theoretical basis. Based on the stages of measurement scale creation and validation suggested by DeVellis and supported by Churchill Jr.’s :64–73, 1979) suggestions, five different empirical studies are developed expressly and applied to consumers of tourist services. This research involves 1147 real tourists from 24 countries in two different cultural (...) and geographical contexts. A three-dimensional 18-item scale is proposed for measuring consumer perceptions of corporate social, environmental and economic responsibilities. Une théorie qui veut établir les principes d'une science du droit, mais dont les fondements épistémologiques remontent aux premières années du XXe siècle, peut-elle garder sa validité de nos jours ?

Who Comes After the Subject offers the most comprehensive overview to date of contemporary French thinking on the question of the "subject." Nineteen philosophers and critics offer diverse perspectives on the subject as it has manifested itself in our modern discourses: the subject of philosophy, of the State, of history, of psychoanalysis. Each contribution asks What has become of the subject? or What has the subject become? in the wake of its critiques and deconstructions .

In this paper we discuss the extent to which the very existence of substructural logics puts the Tarskian conception of logical systems in jeopardy. In order to do this, we highlight the importance of the presence of different levels of entailment in a given logic, looking not only at inferences between collections of formulae but also at inferences between collections of inferences—and more. We discuss appropriate refinements or modifications of the usual Tarskian identity criterion for logical systems, and propose an (...) alternative of our own. Resumen El concepto de amor historicamente ha ruborizado a la filosofia, pues se mantiene totalmente ajeno a las exigencias de dar una explication critica de si mismo. El amor ha respondido con resistencia muda a los interrogatorios del pensamiento critico. De hecho, parece existir un consenso respecto de que el amor se situa en un territorio mas alla de lo pensable y en la doxa romantica se ha establecido que el amor es un tipo de intensidad que no puede reducirse (...) a ningun principio regulador. Como senala Alain Badiou, es "lo que se sustrae de la teoria". En este ensayo me opongo a una postura tan antifilosofica y exploro el parentesco del amor con el pensamiento y la verdad. Basado principalmente en la obra de Jean-Luc Nancy y Alain Badiou, sondeo la relation entre amor y pensamiento, pues ello constituye una ocasion para que nos percatemos de la "connivencia intima entre el amor y el pensar", en palabras de Nancy. En un momento en que el amor se ve amenazado por acusaciones de no ser nada mas que un "optimismo cruel", sugiero que Nancy y Badiou hacen una defensa filosofica del amor al subrayar su parentesco con el pensamiento y la verdad.The concept of love has historically been somewhat of an embarrassment for Philosophy because it remains relentlessly oblivious to the demands for it to present a critical account of itself. Against the interrogations of critical thought, it has only responded with mute resistance. indeed, the consensus seems to be that love dwells in the domain beyond the thinkable, and it is ensconced in the Romantic doxa that it is a form of intensity that is not subject to any organizing principle. As Alain Badiou observes, it is "what is subtracted from theory". In this essay, I oppose such an "anti-philosophical" position, and offer an exploration of love's kinship with thought and truth. Drawing primarily from the work of Jean-Luc Nancy and Alain Badiou, I explore the relationship oflove and thought, for it is an occasion that obligates one to realize the "intimate connivance between love and thinking," to use the words of Nancy. At a time when love is threatened by accusations ofbeing nothing more than a "cruel optimism", I suggest that Nancy and Badiou offer a philosophical defense of love by underscoring its kinship to thought and to truth. The establishment of Mexico's National Bioethics Commission (Comisión Nacional de Bioética), in 1992, was conceived within the context of a global movement aimed at raising awareness of the ethical implications of technological and scientific development, especially in biomedicine. In 2005, a new decree put the commission under the scope of the Secretariat of Health and granted it technical and operational autonomy, allowing it to become a regulatory agency aimed at promoting a culture of bioethics, encouraging reflection on human health, and (...) developing guidelines for health care, research, and education, through a global, secular, and democratic perspective. The commission became the leading actor in the strategy for institutionalizing bioethics in Mexico after reforms to the country's General Health Act in 2011, which required that public, social assistance, or private health care facilities establish a hospital bioethics committee to address bioethical dilemmas or issues and, when relevant, a research ethics committee to address research with human subjects. This assignment has shifted the focus of the activities and goals of the National Bioethics Commission toward establishing these committees in line with current regulations and developing mechanisms to ensure that they operate with the highest standards of ethical conduct, performance, and accountability. En este artículo se sostiene la siguiente hipótesis: si una hipótesis tiene valor epistémico para Hume, este valor tiene que provenir de la intuición. Para ello se consideran las tres posibles fuentes de conocimiento en su pensamiento: la demostración, la experiencia y la intuición. Considerando que Hume presenta su doctrina de la creencia como una hipótesis, se argumenta que el valor epistémico de las hipótesis no puede provenir de la demostración ni de la experiencia y, por tanto, o las hipótesis (...) carecen de valor epistémico o su valor epistémico proviene de la intuición. Para sostener la hipótesis propuesta se ofrece un análisis de la evidencia textual sobre la hipótesis y la intuición a la luz de la literatura disponible sobre el tema. (shrink)

When discussing Logical Pluralism several critics argue that such an open-minded position is untenable. The key to this conclusion is that, given a number of widely accepted assumptions, the pluralist view collapses into Logical Monism. In this paper we show that the arguments usually employed to arrive at this conclusion do not work. The main reason for this is the existence of certain substructural logics which have the same set of valid inferences as Classical Logic—although they are, in a clear (...) sense, non-identical to it. We argue that this phenomenon can be generalized, given the existence of logics which coincide with Classical Logic regarding a number of metainferential levels—although they are, again, clearly different systems. We claim this highlights the need to arrive at a more refined version of the Collapse Argument, which we discuss at the end of the paper. (shrink)

Many authors have considered that the notions of paraconsistency and dialetheism are intrinsically connected, in many cases, to the extent of confusing both phenomena. However, paraconsistency is a formal feature of some logics that consists in invalidating the rule of explosion, whereas dialetheism is a semantical/ontological position consisting in accepting true contradictions. In this paper, we argue against this connection and show that it is perfectly possible to adopt a paraconsistent logic and reject dialetheism, and, moreover, that there are examples (...) of non-paraconsistent logics that can be interpreted in a dialetheic way. This article discusses the relation between colonialism and the sovereignty of peoples through a dialogue between Hegel and the thought of the French Revolution. These two sides are relevant to each other not only because of their historical proximity, but also because of the connections that can be established when we approach the topic of colonialism through these two manifestations. Hegel is explicit that his philosophy of history and his philosophy of right are supposed to be philosophies of freedom. Yet (...) despite the importance that he lends to freedom, Hegel also explicitly defends, in the very same text, colonial domination when he deals with the relation between peoples. A similar problem had arisen in the course of the French Revolution. Following the declarations of war, France is confronted on various occasions with the question of how to deal with other peoples and countries. With the foundation of the Republic in 1792, the relation with other peoples becomes central in the revolutionary debates. The topic of colonialism is part of the constituting debates, and not only because of the uprisings in then Saint Domingue leading to the Haitian Revolution. This article is a part of a larger research project that attempts to reassess the relations between Hegel and the French Revolution, and deals with the question of how we can re-read Hegel's interpretation of the French Revolution based on the evolving historiography of the Revolution. After an introduction of both sides of this dialogue, the paper discusses how Hegel's political philosophy can be applied to understand the debates about the emancipation of colonies that take place during the French Revolution. The next part further analyses some issues, such as the notion of sovereignty and, in the concluding remarks, I summarize my discussion and point to some avenues for further research. (shrink)

RESUMENLa segunda etapa del pensamiento filosófico de Ayer es conocida como «fenomenalismo analítico» y se caracteriza por su afirmación: lo que conoce el sujeto no son más datos sensoriales. Esto conlleva la necesidad de de crear lo que se conoce como el lenguaje de «los datos sensoriales», que debería ser previo al lenguaje ordinario y al que podría traducirse el primero mediante la provisión de una serie de reglas con este objeto.
